Lease Agreement
Rental Application Form—Tenants should fill out this document before signing the New Hampshire Lease to Purchase Option agreement, as it allows the Landlord to verify their credit and employment history by doing a background and credit check. As of January 1, 2025, Landlords must disclose any application or renewal fees in writing to applicants.
Purchase Agreement – The contract becomes an NH purchase agreement if the Tenant decides to buy the property.
Landlord-Tenant Relationship Laws
The District Division of the New Hampshire Judicial Branch (1) governs the Landlord-Tenant relationship laws, including the following:
- Evictions – The rules for how and when a Landlord can evict a Tenant.
- Security Deposits & Tenant Rights – This law limits the amount Landlords can collect for security deposits and the time they must return them to the Tenant.
- Habitable Property Conditions – Landlords must keep rental units safe and livable.
- Fair Housing – Bans discrimination in renting based on race, gender, disability, or sexual orientation.

Required Disclosure Forms
New Jersey law requires landlords to provide the following disclosure forms:
- Truth-in-Renting Act Notice [English PDF Guide] [Spanish PDF Guide] – for properties with more than two (2) rental units. [2]
- Lead-Based Paint Disclosure Form and EPA Pamphlet – for properties built before 1978.
- Flood Zone Disclosure Form [Flood Risk PDF] – Landlord must disclose if the property is in FEMA’s Special Flood Hazard Area or Moderate Flood Hazard Area. Landlords must disclosure if any of the property has been subject to flooding such as common areas or parking spaces. [3]
- Security Deposit Notice – Landlord must disclose where the deposit is held. [4]
Security Deposit Limits
- Maximum Amount – Landlords cannot charge more than one and a half (1.5) months’ for the deposit amount.
- Interest Account – Deposits must be kept in an interest-bearing account.
- Location – The tenant must be informed where the funds are kept (security deposit notice). [5]
