  1. Lead-Based Paint Disclosure Form & EPA Pamphlet – Under The Minnesota Lead Poisoning Prevention Act, if property was built before 1978 then the lead-based paint disclosure must be give to Tenants along with the EPA pamphlet. [1]
  2. Radon Disclosure Form – Any known radon must be disclosed along with the records of mitigation and testing. [2]
  3. Foreclosure Notice – The Landlord must inform the Tenant if the rental property is in foreclosure and the lease cannot exceed two (2) months. [3]
  4. Landlord/Manager Contact Information – The lease must include the name and contact information of the Landlord or property manager. [4]
  5. Property Disclosure Statement – All material facts must be disclosed to the Tenants.
  6. Fee Disclosure – Rent and all required fees must be listed as “Total Monthly Rent” on the first page of the lease. [5]
  7. Move-in Inspection – Tenant must have the option to conduct a move-in inspection within 14-days if a security deposit is collected.
  8. Service/Support Animals – Landlords cannot charge extra fees or deposits for service or support animals. [6]
  9. Shared-Meter Utilities – If utilities are sub-metered, bills must be based on the actual usage readings. [7]
  10. Covenant of Unlawful Activities – The following must be included in the lease agreement: [8]

1.) Allow controlled substances in those premises or in the common area and curtilage of the premises in violation of any criminal provision of chapter 152;

2.) Allow prostitution or prostitution-related activity as defined in section 617.80, subdivision 4, to occur on the premises or in the common area and curtilage of the premises;

3.) Allow the unlawful use or possession of a firearm in violation of section 609.66, subdivision 1a, 609.67, or 624.713, on the premises or in the common area and curtilage of the premises; or

4.) Allow stolen property or property obtained by robbery in those premises or in the common area and curtilage of the premises; and

5.) The common area and curtilage of the premises will not be used by either the landlord or licensor or the tenant or licensee or others acting under the control of either to manufacture, sell, give away, barter, deliver, exchange, distribute, purchase, or possess a controlled substance in violation of any criminal provision of chapter 152. The covenant is not violated when a person other than the landlord or licensor or the tenant or licensee possesses or allows controlled substances in the premises, common area, or curtilage, unless the landlord or licensor or the tenant or licensee knew or had reason to know of that activity.

Required Disclosure Forms

  1. Lead-Based Paint Disclosure and EPA PamphletLandlords must disclose to Tenants if the rental properties were built before Jan. 1st, 1978, and provide the lead-paint hazards and EPA pamphlet informational form.
  2. Truth in Renting Notice – Must disclose the following information in a 12-point or higher font: “NOTICE: Michigan law establishes rights and obligations for parties to rental agreements. This agreement is required to comply with the Truth in Renting Act. If you have a question about the interpretation or legality of a provision of this agreement, you may want to seek assistance from a lawyer or other qualified person.”
  3. Domestic Violence Protection Notice – Tenants must be informed in the residential lease agreement that if they or their child is a victim of domestic violence, sexual assault, or stalking, then all rental obligations shall be released. The agreement must include the following information: “A Tenant who has a reasonable apprehension of present danger to him or her or his or her child from domestic violence, sexual assault, or stalking may have special statutory rights to seek a release of a rental obligation under MCL 554.601b.”
  4. Inventory ChecklistLandlords must give Tenants two (2) identical copies of the checklist, and the Tenant must sign and return one (1) copy to the Landlord within seven (7) days of receiving it.
  5. Security Deposit Notice – The name and location of where the deposit is held must be disclosed to the Tenant within 14 days of the lease start date.
  6. Disclosure of Environmental Hazards – Landlords must disclose all known environmental hazards such as asbestos, radon gas, formaldehyde, fuel tanks, chemical storage, and contaminated soil.

Security Deposit Laws and Returning Requirements

  • Maximum Amount – No more than two months’ rent. [8]
  • Returning Deposit to Tenant – for a fixed-term lease Landlords must return the deposit within 30 days after the tenant moves out and for month-to-month leases the Landlord must return the deposit within 21 days. [9]

Rent Payment Laws and Late Fees

  • Grace Period – 15 days. [10]
  • Maximum Late Fee – Cannot charge more than 4% of the monthly rent. [11]
  • NSF Fee – 12% of the monthly rent for a bounced rent check. [12]

Breaking the Maine Residential Lease Agreement

Tenants can terminate the Maine residential lease agreement with no penalties by one or more of the following circumstances:

  • Active Military Service – Tenants who enter active military service after signing a lease are protected under the federal Servicemembers Civil Relief Act (SCRA). If a tenant is called to active duty or receives a permanent change of station, they have the right to terminate their lease early. In order to break the lease under this protection, the tenant must provide the landlord with written notice and a copy of the military orders. The lease will terminate 30 days after the next rent payment is due.
  • Victims of Domestic Violence, Sexual Assault, or Stalking
  • High Radon Levels – Under Maine law, landlords are required to disclose the presence of radon gas in rental properties. If radon levels are found to be above 4.0 picocuries per liter (pCi/L)—the level considered hazardous by the Environmental Protection Agency—tenants may be entitled to terminate the lease without penalty. The landlord is required to mitigate the radon within a certain timeframe or else the lease can be terminated. Tenants must provide notice and evidence of the radon levels if they choose to end the lease for this reason.
  • Unsafe living conditions – Tenants have a legal right to live in a safe and sanitary residence. If the rental unit becomes uninhabitable due to serious maintenance issues, health hazards, or code violations, the tenant may be allowed to break the lease without penalty. Examples include persistent mold, lack of heat or water, severe pest infestations, or structural problems. The tenant should first notify the landlord in writing and give them a reasonable amount of time to make necessary repairs.
  • Landlord breaks the implied warranty and covenant of habitability – Maine law imposes a legal obligation known as the warranty of habitability, which requires landlords to maintain rental properties in a condition fit for human habitation. This includes ensuring that the premises are weather-tight, equipped with working plumbing and heating systems, free of vermin, and compliant with all health and safety codes. If a landlord fails to uphold this responsibility, and the living conditions become unacceptable, the tenant may terminate the Maine residential lease agreement contract.
