Tenants Right to Sublet

New Jersey  does not have specific laws on subletting therefore it depends what is in the lease agreement. If the lease does not mention the rules on subletting then get the Landlord written consent with a Landlord Consent Form to make it official.

Short-Term Rental / Lodgings Tax

  • The New Jersey Division of Taxation imposes taxes on short-term rentals (also called “transient accommodations”) for stays of less than 90-days. [1]
  • Statewide Short-Term Rental Taxes:
    • 6.625% State Sales Tax [2]
    • 5% State Occupancy Fee [3]
  • Local governments also apply additional taxes and vary by location. For example, rentals in the Meadowlands area include a 3% Meadowlands Regional Hotel Use Assessment.

Joint and Several Liability

The NJAR lease agreement is a standardized legal document used by Realtors in New Jersey to stay compliant with New Jersey state rental laws.

What is Included?

This form outlines Landlord and Tenant obligations, rent payment terms, security deposit rules, and rental conditions.

Required Disclosure Forms

New Jersey law requires landlords to provide the following disclosure forms:

  1. Truth-in-Renting Act Notice [English PDF Guide] [Spanish PDF Guide] – for properties with more than two (2) rental units. [2]
  2. Lead-Based Paint Disclosure Form and EPA Pamphlet – for properties built before 1978.
  3. Flood Zone Disclosure Form [Flood Risk PDF] – Landlord must disclose if the property is in FEMA’s Special Flood Hazard Area or Moderate Flood Hazard Area. Landlords must disclosure if any of the property has been subject to flooding such as common areas or parking spaces. [3]
  4. Security Deposit Notice – Landlord must disclose where the deposit is held. [4]

Security Deposit Limits

  • Maximum Amount – Landlords cannot charge more than one and a half (1.5) months’ for the deposit amount.
  • Interest Account – Deposits must be kept in an interest-bearing account.
  • Location – The tenant must be informed where the funds are kept (security deposit notice). [5]

Required Disclosure Forms (5)

    1. Lead-Based Paint Disclosure – Must disclose health hazards and EPA information related to lead-based paint for all properties built before 1978.
    2. Flood Risk Disclosure– If the rental property is located in a flood zone, the Landlord must disclose this information to Tenants.
    3. Flood Insurance Disclosure – Notice must include the following:

      “Flood insurance may be available to renters through FEMA’s National Flood Insurance Program to cover your personal property and contents in the event of a flood. A standard renter’s insurance policy does not typically cover flood damage. You are encouraged to examine your policy to determine whether you are covered.”

    4. Truth-In-Renting Act – Written notice of rights and responsibilities during the lease term.
    5. Window Guard Disclosure – The Landlord must provide the Window Guard Disclosure form and it must include the following text in bold font:

      “The owner (landlord) is required by law to provide, install and maintain window guards in the apartment if a child or children 10 years of age or younger is, or will be, living in the apartment or is, or will be, regularly present there for a substantial period of time if the tenant gives the owner (landlord) a written request that the window guards be installed. The owner (landlord) is also required, upon the written request of the tenant, to provide, install and maintain window guards in the hallways to which persons in the tenant’s unit have access without having to go out of the building. If the building is a condominium, cooperative or mutual housing building, the owner (landlord) of the apartment is responsible for installing and maintaining window guards in the apartment and the association is responsible for installing and maintaining window guards in hallway windows. Window guards are only required to be provided in first floor windows where the window sill is more than six feet above grade or there are other hazardous conditions that make installation of window guards necessary to protect the safety of children.“

New Jersey Lease Agreements Must Include the Following

Security Deposit

Maximum Amount – The maximum amount Landlords can request from Tenants equals to 1 and 1/2 months’ rent for the first year and 10% of the current security deposit the following years.

Returning to Tenant – Landlords must return all deposits within 30 days of the lease end date. An itemized list is required if any deductions are taken out of the deposits by the Landlord.

Landlord Access

General Access – Landlords must give Tenants 24-hours notice prior to entering the rental property.

Emergency Access – Landlords can access the rental units in an emergency and do not need to give Tenants any notice.

Paying Rent

Grace Period – No grace periods in the state of New Jersey except for senior citizens are granted a 5-day grace period.

Maximum Late Fee – Landlords can charge any amount for late rent as there are no laws governing late fees in New Jersey.
