District of Columbia residential lease agreements are regulated by the Residential Lease Clarification Amendment Act. [1]

Washington D.C. Residential Lease Requirements

In-writing – Leases that are longer than one (1) year must be in writing. [2]

  1. Lead-Based Paint Disclosure Form and EPA Brochure – Landlords must provide a disclosure form and EPA brochure for properties built before 1978.

  3. Rad Form 3 – Landlords must provide tenants with a copy of Housing Provider’s Disclosures.
  4. Rad Form 5 – Landlords must provide tenants with a copy of the Notice of Disclosure Forms.
  5. Voter Registration Form – Landlords must offer tenants a voter registration form.
  6. Bed Bugs Fast Sheet – If bedbugs were found in the last 120 days, Landlords must inform Tenants in-writing before signing a lease.

Required Disclosures Forms

  • Maximum Amount– The maximum for yearly rental agreements is one month’s rent. For month-to-month leases, the landlord decides the amount. [5]
  • Returning deposits to tenants deadline – The landlord must return the security deposit within 20 days of the tenant moving out, along with a list of any deductions.

Landlord Access to Rental Property

The landlord must give the tenant at least 48 hours’ notice before entering the rental unit. [6]
