Wisconsin Residential Landlord & Tenant Act
Summary (Wis. Stat. §§ 704): The Wisconsin statutes outline responsibilities for both the landlord and tenant which include the following..
- Maintenance of the property – Landlord and tenants are responsible for keeping the property safe and habitable. Must keep up with local building and housing codes.
- Security Deposits – Landlords must return the security deposit within 21 days of the tenant vacating the property.
Security Deposit Law
Summary (Wis. Admin. Code ATCP 134.06): Landlords in Wisconsin can charge any amount for a security deposit but must return it within 21 days after the tenant vacates. Deductions for damages must be itemized and provided to the tenant.
- 21 Days – Amount of time landlords have to return the deposit.
- Deductions must be accompanied by an itemized list of damages.
- Normal wear and tear cannot be deducted from the security deposit.
Lease Termination
