A North Dakota Month-to-Month Lease Agreement Template offers a flexible rental arrangement for both Landlords and Tenants seeking short-term commitments. Unlike fixed-term leases, this agreement automatically renews each month until either party decides to terminate it.

Minimum Termination Notice Period

  • The Landlord has thirty (30) days written notice for month-to-month tenancy. [1]
  • If the Tenant disagrees, then the Tenant has twenty-five (25) days to terminate the lease.

Increasing Rent Notice

North Dakota does not have specific laws requiring Landlords to give notice before raising rent.

Optional Clauses

Optional clauses in the template cover pet policies, smoking policy, late fees clause, guest policy, and landlord entry notice.

Security Deposit Laws

The security deposit cannot exceed one (1) month’s rent. If the Tenant has a pet (excluding service animals), an additional pet deposit of up to $2,500 or two (2) months’ rent (whichever is greater) may be charged. The security deposit must be held in an interest-bearing, federally insured account, and any remaining balance must be returned to the tenant within thirty (30) days after the lease ends. [2]
