Required Disclosure Forms (5)

  1. Copy of Landlord-Tenant Code – Landlords must provide tenants with a copy of the “Summary of the Delaware Residential Landlord-Tenant Code.” [1]
  2. Owner/Agent Identification – Landlords must include the names and business addresses of all property owners or their resident agents and the names and business addresses of anyone named a landlord under § 5141 of the Delaware code.[2]
  3. Bed Bug Disclosure Form – Landlords must inspect the property for bed bugs and disclose to Tenant if bed bugs are present in rental unit or being treated in the rental unit or adjacent units. [3]
  4. Lead-Based Paint Disclosure and EPA Pamphlet (conditional) – Required for properties built before 1978.[4]
  5. Right to Legal Representation (conditional) – If the landlord owns more than three (3) rental units and the tenant’s income is below 200% of the federal poverty guideline then Tenants may qualify for free legal representation during a eviction proceeding. [5] [6]
