An Idaho lease agreement is a contract between a landlord and tenant for property use in exchange for rent. The landlord may request a rental application to verify the tenant’s credentials, and upon approval, both parties can sign the lease.

Rental application – Used by Landlord to verify the financial capacity, occupational status, prior history, and records of potential Tenant(s) before signing the lease.

Security Deposits

Maximum Amount – Landlords have no limit on the amount they can charge tenants.
Return – In the absence of a specified return period for the security deposit in the rental agreement, the landlord is required to dispatch it to the tenant within twenty-one (21) days following verbal agreements. However, if the lease agreement specifies a particular time-frame for the refund, the landlord has a maximum of thirty (30) days from the move-out date to remit the deposit.

Landlord Access

There is currently no state-level legislation mandating Landlords to provide Tenants with notice prior to entering a rental property for maintenance or any other purpose. Typically Landlords give Tenants notice of at least 24-hours before entry.

Paying Rent

Grace Period – Idaho does not have a statutory grace period for rent payments. The landlord can use a 3-day notice to quit if rent is not paid on the due date specified in the lease.

Maximum Late Fee – Under Idaho law, there are no regulations in place for rent late fees. As a result, landlords are allowed to charge tenants any amount they deem suitable.

NSF Fee – $20 per bounced rent check.
