Security Deposits

Tennessee Landlord-Tenant Relationship Laws

The Tennessee Code Annotated Title 66, Chapter 28 statute outlines the rights and responsibilities of landlords and tenants, including regulations about rental agreements, security deposits, and eviction processes.

Security Deposit Laws

  • 30 Days – Landlords must return the security deposit within 30 days after the lease end date.
  • Collecting Interest – The Landlord does not have to pay interest on deposit.
  • Maximum Deposit – The maximum amount should be written in the lease agreement as there as no mandates for the maximum amount that can be requested in Utah.

Lease Termination Rules for Landlords and Tenants

  • Month-to-month: 15 days’ written notice.
  • Week-to-week: 7 days’ written notice.

Landlord’s Access to the Rental Property Notices

Landlords must provide 24 hours’ notice before entering the rental property, except if there is an emergency, then the Landlord does not have to give prior notice.

Rent Due Dates and Late Fees

  • Grace Period – 5-days grace period.
  • Late Fees – The maximum late fee allowed is 10% of the rent.

Eviction Process for Landlords

  • Notice to Pay or Quit – Landlords must provide a 14-day notice before beginning the eviction process.

  • Agent/Landlord Identification – The name, address, and phone number or email address of the landlord or property owner must be given to the tenant.
  • Property Showings – The Landlord has the right to show the property during the last 30 days of the lease.
